So we are liable and not covered by any insurance, the club's or otherwise, if we hit a pedestrian on course?

Yes, as has always been the case. The waiver says you acknowledge the risk to yourself and car. It says you can't sue THSCC. It says you can't sue participants.The difference now is that if you still attempt to sue a participant, their car insurances liability will not cover it in the event the waiver doesnt hold up for whatever reason.

Thanks. I figured the car would not be covered but I never thought about the liability involved with the pedestrians on course.

Well you bring up an important point. For instance IF we were to run at the Burlington site which has multiple ingress and egress points, non participating pedestrians could be an issue.

But I think as has been said earlier, an organization/company can not waiver away negligence via signature. The company/organization has a duty to take reasonable precautions so no matter what someone signs if we as a club are negligent then we may be deemed liable.

I don't want to be the one who hits the kid so I will be driving slowly through the pits.
