 Post subject: Notary on Weekend? and selling car out of state

Anyone know where I can get a title/BOS notarized on Saturday?

Also, if I'm selling a car to someone out of state do I just treat the title work etc etc as business as usual and it's ultimately on the buyer to sort out the out of state titel xfer?

your bank open on Saturday? also, around here, some of the storage companies have signs out front showing they have a notary available during business hours, including weekends.

SECU is closed on Saturday. UPS on Fayetteville supposedly has a Notary on staff on Saturday.

Don't know about a notary, but a "titel xfer" sounds kinda kinky.

Just sign and notarize before the weekend. Buyer's name needs no notarization.

Note - some banks will refuse to do this, which is stupid IMO.

The reason not to do that is security...you lose the title and someone finds it and they can put their name on it and claim your car is theirs. So don't lose it once you do that and all is fine.

As for the out of state part, the buyer MAY need a bill of sale as well, so it's a good idea to do one of those. It's a good idea to do two copies that you BOTH sign and you each keep one, too. That way if he kills someone in it on the way home and ditches the car, flees the scene, and then acts like he never bought it and doesn't know what you're talking about, well, you have a bill of sale with his signature, at least.

When things are in ANY WAY weird, it's going to be weird on the buyer's side. So for anyone following along who might be BUYING from out of state, I suggest always get the seller to email or fax you a copy of their paperwork. Take that to the DMV and say "What do I need to do to get this legally transferred to me here in NC?" I've had some odd situations in the past and this saved me some headaches. And I've had headaches prior to that by NOT doing that (like buying a trailer from a SECOND owner in Georgia...that took MONTHS to sort out!).

But as the seller, sign and notarize the thing, do the bill of sale, and get the money in cash and send them on their way. Pretty simple.

Yep, that's why I want a notarized and dated BOS since he has a 13 hour drive back to Chicago.

That's what I did when I sold the S2000 to Ram. Similarly, when I bought the MB, which was out of state, I took the Virginia title with me to DMV, and it was the same basic process.

That said, I learned just a week or two ago that this approach is illegal. According to the woman at the DMV on 55 who did the paperwork for my wife's car, both parties are supposed to be present at the time of title signing. She even said that strictly speaking, it was a misdemeanor offense for the notary who stamps a title that way.

I haven't bothered to look up the laws or any of that kind of thing to see if she was right. After she'd given us her speech, she did all the paperwork anyway. :lol:

The law says only the seller needs to be present and sign the title in the presence of the notary....however, the law says that the buyers information has to be filled out at the time of notarization. The office manager at my company used to be a secretary/notary at a law firm so she showed me the text. However, she then proceeded to notarize my title without the buyer present nor his information filled out :).
