So my son just called to let me know he arrived in New Orleans’s for a print making convention that’s part of an ECU school conference. The story goes he was going w/ the normal traffic flow when Johnny Law decided to make an example of him and tagged him w/ 75 in a 60 zone. What can he expect and what does he need to watch out for? I’m sure he’ll get lots of letters in the next few weeks.

Any advice?

The last I heard 15 or less over doesn't get reported back to your home state, however I heard that a long time ago, so it may no longer be correct. I'd suggest he talk to a lawyer first and if this is still the case, just pay the ticket.

I think that is what Bowie's traffic attorney told me when I was tagged for 76/65 in Dinwiddie, VA. It has to be in a 55mph or higher speed zone and I think no more than 15 over. In that case, the DMV isn't supposed to record drivering points. The law doesn't say anything about insurance points... so I found an attorney up there and had it reduced.

Do a web search for that specific state. For Example, florida has online schools you can do that make the ticket disappear. If that doesn't work, check with lawyer. 75/65 would be chargeble in nc on insurance.

If he can get that reduced down to 70 in a 60 zone, and if the other conditions in the quote below are true, then you would have no insurance points from this. I've done this on my own in NC by going to the DA's office and offering to plead guilty and pay the fine in return for the reduction in charge. Took care of it in one visit. I don't know how things work in Louisiana though.

From the NC DOI publication It Pays to Be a Safe Driver Insurance Points

are true:

• The violation did not occur in a school zone; and
• There is not another moving traffic violation for the experience period
(an isolated Prayer for Judgment Continued [PJC] will not count as a
prior conviction for the purpose of this exception).

Problem is (and Cline can correct me if I'm wrong), even if it doesn't make insurance points, any insurance "safe driver" discounts can vanish if any moving violation appears. Last time we had a ticket in my household (multiple cars, motorcycles, boat, but no licensed kids) I figured the loss of dicsounts was worth $2200 over 5 years even at a reduction to 1 mph over. So, $2200 became my budget for the moving violation to "go away".

My advice, and I've said it before, is wait for all the letters to arrive. Throw out all the sketchy and scare-tactic ones, then call the rest and learn how the system works down there. Hire the most competent or most-related-to-the-judge attorney you can find if the system has a "lever" that can be pulled. If no lever, or if you have no discounts to lose, then ... I have no idea what you should do.

YOu are correct, depending on the company it can cost you big. Bottom line, you don't want anything on your record if you can help it.

My 61 in a 35 (yes 26 over) got dropped to a 44 in a 35 (I went by myself with my 10 year clean NC driving record) and the ADA said "that's the best driving record I've seen in this courtroom ever". Anyway, I plead guilty to 9 over and the fine was reduced and for the next two 6 month periods, my insurance premium (net) dropped (the base rate went up just due to inflation whatever but the discounts increased as well) so you don't *always* lose discounts.

You are allowed one 9 over per three years so I guess maybe insurance companies don't learn of this?

I have USAA insurance.

Most companies discount for what I call "the walk on water discount" If you have nothing on your record, not a freebie ticket, no comprehensive claim, not even a not at fault accident. So while the freebie ticket is not "surchargeble" you can lose a discount. It can also cause the "freebie 1 pt accident" to be charged because you now have a conviction on your record. It depends on the company though.
