My thoughts exactly Donnie.

Without video from other angles, I gotta think this guy was on the shoulder/grass LONG before he ever got close to the cop. (Or at least long enough that the cop's position didn't have anything to do with the accident.) The car was just too stable to have just tried to avoid the car (this IS an '85 firebird we're talking about LMAO). I dunno... I guess you do see him leave the pavement... so maybe not.

As far as the brake lights, it looks to me like he hits an earth berm/ditch, not the guardrail to get launched like that, and the "impact" there could have moved his feet such that he hit his brake pedal.

It's fun to speculate, but like any freak accident (whether on purpose or not), we'll never know the details.
