Ok, Class here's the deal.

NC and Texas are weird states to do business in. For what ever reason, NC will not allow the exclusion for track events. Steve's Key Factors are not correct. Maybe it is our Moonshining Nascar roots or just cause the Insurance Commissioner likes to piss off the companies.

HUGE EXCEPTION READ THIS !!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!
COMMERCIAL POLICIES CAN EXCLUDE TRACK EVENTS!!!!!!!!!!!!!!!!!!!!!!
COMPANIES CAN EXCLUDE COVERAGE FOR WHAT THEY CALL MISREPRESENTATION, SO IF YOU FIB IT CAN BITE YOU IN THE BUTT!!!!

While I am a very understanding agent I can only do what my companies allow me to do. In Bernie's case I told him. " Here is the deal you are going to call in and tell them what happened, they are going to go ape crap and tell you it is not covered because they are in LA and they don't know NC law, you just tell them you want to talk to a supervisor." TWO minutes later Bernie calls "THE SAID IT'S NOT COVERED!!!!!" Bernie remember what I said "WAIT A MINUTE THEY ARE CALLING ON THE OTHER LINE HOLD ON....OK THEY SAY ITS COVERED BECAUSE IT IS NC"

Bernie's insurance was not cancelled because that company is 100% computerized and the underwriting just sees it as an accident no details.


So, as Mike said. Go ahead and turn it in but expect to be cancelled at renewal. I am an independent agent have multiple companies so if Bernie would have been cancelled we would have just gone to another company and listed a one car incident in Rockingham NC with 32k in damage. He would then be treated the same as any body who happened to have an accident of say hitting a tree in the parking lot at JC Penney. (who gets that) There is not a question on the Auto applications that ask if the accidents were on the race track, ax, hpde, etc.

Bernie's situation not with standing, EXPECT THE WORST CASE SCENERIO IF YOU REPORT A CLAIM. I agree with Steve on track something you can walk away from. OR buy on track coverage.

Any more advice and I will have to start charging.

It seems what most people are worried about is whether their car will be covered when instead they should be worried about whether THEY will be covered in terms of liability. Having to fork over your own $32k to fix your car is one thing (if for some reason you weren't covered), but having a multi-million dollar lawsuit battle is quite another. Granted "everyone signs the waiver", etc, etc, but if you cause a death of another participant, and some sort of gross negligence can be directed at you, the car coverage will seem like the last thing you care about. (i.e. witness the successful lawsuits in some worst case outcomes like the Carrera GT deaths a couple of years back).

Hence the question Cline about liability coverage. If someone buys a car they will write off if wrecked (trailers it to the event, not registered on street), I assume many of these people do not even consider liability coverage? (surely they must!) What about umbrella liability policies you've seen written in NC? I assume they will not have some exclusion? I've never actually read the fine details -- are umbrella policies similarly highly regulated in NC?

What about an autocross where a driver hits and kills a course worker? This is a "timed speed event", so if someone just has a "normal" auto insurance policy, even though they won't have collision/comp coverage due to the nature of the event, does that also apply to the liability coverage of the policy?

i had a liability policy on my track car for a period of time. seems i had a tendency to crowd high dollar P-cars and my agent felt i might want to protect myself from those lawyer / doctor types. :lol:

For Liability claims those should be filed no questions asked, I was not talking about those.

I am less worried about hitting little shirtless chiropractors on track than I am kids running in the paddock. If you hit them, they stick their hand in the engine, etc it's your fault, end of story.

I can not answer all exclusions in other companies Umbrella policies. My companies have no exclusion for track events. YOUR CAR MUST BE COVERED UNDER AN UNDERLYING POLICY TO BE COVERED UNDER THE UMBRELLA.

Ok guys I am going to quit looking at this thread as it stresses me out and makes me want to quit the track. I about had an anxiety attack at Lemons!

Thanks for correcting me. I edited my post to be more in the form of a question so as not to mislead people. Makes me feel better about hypothetically taking a cheap car to HPDE...

I think there's a lot of misunderstanding out there because everyone (at least me) is worried about having our policy cancelled for even mentioning it with our agents.
