 Post subject: noob out of state car sales question

ok i think i found a buyer for my car, but he is out of state. here is his email:

Does that mean he needs the bill of sale in order to get the loan? if so isnt that risky? does that mean he owns the car legally (even tho the title hasnt been transferred) before i get my money? should i have him pay up front and then send all the paper work?

i dunno how this works. thanks :)

Sounds a bit risky to me. I've sold two cars to people out of state. They both used a tag off of another vehicle to drive the car back home. The best way to do the transaction is at your bank. If you have a loan on the car, let the bank know ahead of time, so that they can have the title ready.

Something's not right there Dan. He should be able to get the loan without any information other than the VIN to prove what car he is buying. I would press him to get the loan, pay you, and then work out the paperwork (like Jason said) - AB

No way, don't do it. Don't be a prick about it either, but tell him that there are other "better" ways of handling it.

Any NC DMV can issue a 30-day tag here for your/his car for his trip home -- or he can "risk it" with a plate from another vehicle, although the jury's out on whether that's legal cross-borders.

That email would have pegged my scam meter except for the fact that it is written in clean understandable English. Maybe the scammers have gotten more sophisticated...

Watch Out. This "refund" aspect sounds an awful lot like one of the scams that are common from overseas or elsewhere.

When I sold a car out of state the guy paid me cash and we went to a Notary (at Carmax since the are close and it was a weekend) to sign over the title. He then drove the car home and mailed the plate to me.

i told him id feel more comfortable if he sent the money directly to my bank first. he said ok, so i guess we'll see..

This is a very dangerous practice. Never, ever, let someone take your plate. I have a friend who got in a lot of trouble when the dude who bought the car had his plate and got a reckless driving ticket driving it home. - AB

Aaron,

I thought driving tickets apply to the driver's license, not the car's. :?

Wouldn't the date/time on the bill of sale help?

What do you guys who frequently buy/sell cars do about a plate, in state or out of state?

what MY bank wants to do is this:

have him fedex a registered check directly to my bank. then my bank will get the title and i can sign over the title and have it notorized there. then they can mail his bank the title so he can then go to his bank and sign the title.

but they werent sure if his bank would require more paperwork like an appraisal, etc.

When I sold the Talon, the guy got the car, thats it. He drove it home with no plate (Greenville, NC to Greenville, SC). No problems unless you get caught!

Sure, that's correct. Problem is, when one has an accident. By state law in NC, you cannot remove insurance on a car until your plate has been turned in. Buyer drives away with your plate, has an accident or better yet, wreckless driving with an accident. Now there are two insurers on the car... you and the new buyer. The car is still technically registered to you and it's your plate on there. Guess who's insurance picks up the tab?

If you guessed the new buyer, you're dead wrong. My buddy has $4000 a year insurance for about another 8 months or so due to an idiot buying a car, having a wreckless driving ticket issued by causing an accident and the two cars involved sued his insurance company.

Thanks for the heads up.

So, what is the "correct" proceedure? Only sell when a license plate agency is open might work for an NC buyer but what about for out of state?

I think someone mentioned it, but NC will issue a temp tag for things going out of state. Yes, it does make things more difficult, but at least the seller is covered. - AB

Many states will allow a current tag from another car to be used on a "just purchased" car from out of state for the purposes of getting the car back to the state and getting it inspected. The registration info from the original car, insurance info, and the bill of sale must be in the new car whenever it's being driven. NC did this at one time, and may still do it. Have your buyer check the Ohio DMV site and look for a section on "buying a used car out of state"

Last time I asked, some nice lady at NCDMV said "it's probably fine, just be sure to explain this to the cops if you get pulled over". Then I called someone else and they said "you can use a tag from another car for up to 30 days if you are planning to transfer that tag to the new car. Just be sure to keep the signed title with you to provide ownership." It was hard to get a real answer.

Problem is you have to check the laws for each of the states you plan to drive through. I took the risk with the M3 I drove here from Ohio and used an existing tag. Got away with that. Earlier this year when I went up to PA to get the bus, I picked up a temporary PA 30 day tag to drive it home. Except for one minor glitch (the title was a MD title) it was easy.
