This is an incredible enactment, made I believe in 1953, By legislators who were trying to stop drag racing. But really knew nothing about racing, cars, gearing, engines, or the terminology of the mechanical devises they were trying to regulate. Unfortunately if this law is used against you. (Almost all of us exceed the posted speed limits at one time or another.) You will be judged by the same types of people, judges, juries or what ever. The term, which is bantered about in this legislation is Potential speed. How that is interpreted in court is the real problem, or potential problem. Some see acceleration as speed, others will look at top end, or terminal speeds, perhaps others will see cornering as potential speed. Case in point, I have a friend that has put a big block crate motor in a 1967 Camero, it develops 608 hp but with the gearing the car top ends at around 130 mph, that’s about five mph slower that it did with the old big block engine. Obviously the car accelerates faster but yet does not attain the original top end !!!!!! The answer to this enigma is a good lawyer, a jury trial with a few mechanics on it. And, oh yeah, try to stop speeding or racing on the streets!!

Why don't we just ask them to get rid of the law?

mike,
As you well know it easier to stop laws before the're enacted and near impossible afterward. we're about 53 years late with this one. Maybe the moonshiners and street racers will help us lobby the legislature, but even if they do I think there's little hope.

At 150HP compared to your 300HP..

I wasn't comparing HP and top speeds, just stating that I don't like the speed limiter, period. More so one at 108mph, although that was probably justified on the Z24...

Laws like this and the futility of our current political processes to evolve and self-simplify are pushing me more toward thinking like a Libertarian.

Let's vote some people into local offices who hate laws out of principal.

A Libertarian here and there would be a refreshing check and balance against the current "more laws" Ass-and-Elephant system.

I agree with your suggestion, but I honestly think you'd have more luck forming a lobbying group as suggested by SEMA. With all of the motorsports clubs in NC, there should be enough people to at least get acknowledged.

I know.

I just think it would still be nice to have a local group fighting against those groups that are pushing for more auto-based laws.

First step would be to have the club fill out this. Please note that there is even a box entitled Any pending legislative/regulatory issues of concern to your club? in the application.

Then in order to gain the most traction, I think it would be necessary to get the other NC clubs involved, including the national clubs with chapters here. I imagine many would have memberships on a national level already.

Maybe I'm missing something... what is it exactly that you guys are wishing that you/we could fight against?

"stupid" legislation in general? the law that this thread originally discussed? something else I'm not aware of?

Just curious.....

(forgive me, but I didn't take time to read all the stuff on the SEMA site.. would that answer my question?)

In case you guys didn't know I made a few changes to the R. Unfortunately with the new law I won't be doing any hot street racing on Capital this Friday night. Damn. Unless of course, you think it might not attract that much attention.

To me, it reads "if you get caught speeding, your car being modified is enough evidence to convict you".

I'll agree that the "potential speed" term is a huge loophole.

Strangely, getting different tires (with a larger actual radius than stock) would be illegal, as it would (theoretically, barring other issues which we are all aware of) change the final drive.

Mike: A couple Libertarians... werd.
