My wife’s mother continues to have issues after the accident a few months ago. Pam has battled the insurance company and has upper their initial offer of $1000 to ~$3000. Considering she's still having issues, we're hesitating to accept the offer and contacting one of the lawyer letters. Is this worth doing? I'm afraid that once Pam signs off on the final offer we remove any further negotiations....

Anyone ever dealt w/ accident lawyers before? Is it worth the pain to engage a lawyer? I’m assuming they take a % of what is awarding to her mother. What’s the typical %?

Is she having issues in what they are willing to award her on her car, or injuries? - AB

Yeah, the lawyer will take a percentage or a fixed fee, but is likely go get far more out of the ins company.

I have a good friend that was badly rear ended while driving a fuel delivery truck. Workers comp did very little so he hired an attorney to go after the negligent driver's insurance company. I don't think he had any regrets. He didn't come out a rich man or anything, but he had his medical expenses covered + some pain & suffering even after the lawyer took his share.

I, on the other hand, was rear ended badly in my old NB Miata and decided to skip the lawyer. I still regret it. Ended up losing money and having lots of frustrations.

I used the Whitley law firm when I was rear ended by the Budget Rent A Truck. I had a problem with Wake Med. It was a worker's comp case but they started billing my work health insurance instead. Also I got the run around from Budget because the renter did not take out any additional insurance. The Whitley law firm also gauranteed that when it was all said and done that their 1/3 would not be greater than what I would recover.

I got a decent settlement much higher than the initial offer.

1/3 is the standard cut the lawyer gets. And most will talk to you about your case for free.
