So I go to court today for my seatbelt ticket. Got there around 9:45. Talked to the DA, told him I intended to plead not guilty. He tells me to take a seat and wait for my name to be called.... An hour an 15 minutes later, my name gets called. I approach the bench. Judge says "So you are not ready to take care of this ticket today?" Surprised I respond, "Yes, your honor, I am" "How do you plead?" she asks. "Not guilty" I respond. "Well, the officer is not in court today, so we will have to continue this". Thinking to myself....you have to be kidding, right? Let me get this straight...the officer that gets paid to be there doesn't show up, so I have to shell out more of my vacation time to come down here a second time? :x What a bunch of BS!!! :bs:

On a funnier note...you see some interesting folks in court. There is a guy sitting there with dreadlocks...charged with possession of less then a half ounce of marijuana...so Einstein shows up in a t-shirt with a picture of Bob Marley smoking a doobie thicker then my exhaust pipe on it and has the balls to plead not guilty.....and I think to myself....I can't get out of my seatbelt ticket?!?!?!?

Yeah NC courts love to do this, the old no this isn't the actual court date thing.

Has happened to many many times with speeding tickets. Doesn't even help that I have a VA drivers liscene and try to explain that I "drove all the way down here for this".

Reminds me of what happened on the way home yesterday...

I drove the autox car to work yesterday. NCHP had a checkpoint set up close to Four Oaks. I stop, hand the asshole my DL & am searching for the registration when he tells me to pull to the side. I pull over, find the registration & give it to him. He tells me my inspection sticker is expired. I tell him that I know, but the car hasn't been driven in a couple of weeks (okay, it's been driven maybe 3 times) because I've been working on it & driving another car. (Which is mostly true.) It had a check engine light because of an exhaust problem, which had to be fixed before I could get it inspected. (completely true) I was planning to stop by the place in Four Oaks where I get inspections done & see if they could do it today. I didn't get this far, because he wasn't listening. Tells me he'll be right back. I call Christine to tell her it'll be a few more minutes and to tell her why, then he comes back. He asks me how old I am... and he's holding my driver's license in his hand. :roll: I tell him 33, then he asks me if I smoke marijuana. :shock: What... the... f*ck!? I tell him no, and he tells me that my car smells like marijuana. I tell him that he might smell a mixture of cigarette smoke & vanilla air freshener - he tells me he didn't ask about any vanilla air freshener, he asked about marijuana. Do I have any friends that smoke it? NO. I'm pissed at this point, because I'm being harassed by an asshole who wants to take my car apart for no reason. Asks for my right hand, and I hold it out - it's shaking. Are you nervous? No, I'm angry. (with an :evil: look on my face, I'm sure) HE SMELLS MY FINGERS. Then he says, well all I know is I keep getting a whiff of marijuana every time I walk up on your car. I don't reply, because I'm too pissed to say anything. I just sit there & stare at him. He stares back at me for a couple of seconds & hands me a ticket for the inspection sticker. No fine, but $100 court cost. For being 10 days overdue.

I got the inspection done this morning, because I was too late to get it done yesterday. So what do I do now?

And just in case you're wondering, NO, MY CAR DOES NOT SMELL LIKE MARIJUANA. :P

I'll get you were pissed and rightly so IMO. Hell, I get pissed when they just ask me where I'm going! Especially since no matter what the answer is you still end up getting the ticket.

BTW, you didn't have that same Bob Marley shirt on did you? :)

Sitting in court today, I saw a number of folks come in with past due inspection tickets. I think they just made them provide proof of inspection and then let them go without having to pay the court cost....I think. I could be wrong.

Is it just me or have there been like sh*tloads of check points lately. I know within the last 2 months I have encountered 3 of them myself all within about a 3 mile radius in Cary.

I passed through a checkpoint around 8am Sunday (Mother's Day!!) on Aviation Pkwy in Morrisville. Cop saw the helmet strapped into the passenger seat, but didn't say anything to me.

Okay, so I'm going to open up a can of worms here, since I think it is somewhat relevant/related, moderators, feel free to split this off into a separate thread...hopefully I won't be sticking my foot in my mouth too badly!

So, I'm reading this:

Nowhere does it really specify what type of restraining device must be used (aside from the using the verbage "seat belt") except later on when it discusses restraining a child in the bed of a pickup (it says FMVSS approved, which it quotes a strength test).

I know this is an old discussion, some of which I think involves some wives tales and not too many facts when I've talked to other car enthusiasts. Is there a law on the books someone can point to that dictates what type of restraining device you must use, or am I missing it in the above website's text (that it MUST be DOT approved/etc)? Am I in the wrong scope and the answer lies in some national vehicular code?

What if SFI/FIA compliance exceed FMVSS -- is that an acceptable substute (it should be)? Is there some reason I've blanked out on as to why a race harness isn't adequate protection on the street? <blank stare, can't quite understand why something better isn't acceptable aside from the fact that it IS a government entity dictating this...>

Where I'm going with this discussion, is I'll bet that folks that have put in a Schroth 4-point system/DOT/FMVSS approved system have still gotten ticketed for not wearing a belt because of law enfarcement (sic) and I'm wondering if anyone has had the displeasure of being ticketed for only wearing your race harness?

I like my 6-point Sabelts, will be replacing them on a regular basis to comply with racing rules of wear and tear, and would like to just use them on the street and not deal with buckling in the stock 3-point AND the 6-points to be "in compliance".

I guess the point I'm trying to make is stock belts in cars, which after a couple of years, certainly can't be as effective as when they rolled off the showroom floor if racing belts are now tested and have a "shelf-life" -- unless the materals the stock belts are made of don't degrade in sunlight as badly as race harnesses. Surely the belts of my new Sabelt is more effective at protecting me than the 10 year old original Mazda belts?

IIRC, in Japan, the stock restraints are replaced in the inspection/rebuild process when vehicles age more than something like 3 years, which is why used cars are cheap over there...

I'm not sure how cohesive my post is, but I think y'all get my point...any takers on sorting out the mess I've attempted to construct here?

Well your first problem is you are using logic when talking about a gov dept :D

But really it is very simple. It the product is DOT approved and has somehting on it that says so than its OK. Otherwise it isn't.

The Schroth's are the only DOT approved harness. So if you buddy got a ticket the cop is an idiot, no shock there. All he needs is the DOT documetation and take that to court.

I am totally on your side here, but I would guess that the officer was not even scheduled to be there. As you found out, they will just schedule a court day in the future for the officer so he can deal with the "not guilty" group. How many officers did you see in court that day other than the bailiff? I am guessing almost none. They just want you to plead guilty and pay up. :?

With 8 hours less vacation time then I started this saga with, I have a little more faith in the justice system then I started out with this morning. After 3 more hours of courtroom time on my third appearance...I emerge victorious...the verdict...NOT GUILTY!!! My advice for anyone that finds themselves in this situation....go to court if you have the time, don't just pay the fine. The officer remembered not a single thing about the morning in question except what was written on the ticket. I think I pleaded my case well, but basically, the judge said he found me not guilty because I had my seat belt on when the officer actually approached the car, and therefore he felt like the seatbelt law had been "enforced" whether I was wearing it when I passed the officer or not.

I also found out today that it is not ok to "whip it out and do it right there" if you have to go to the bathroom in public and there isn't a bathroom close by...even if it is 4AM and you "jump behind a bush". They should sell admission tickets to court.....if you catch it on a good day, it's quite a show.

Ha ha...The funniest thing I saw in court was when a guy who was charged with assaulting a police officer (as well as a bunch of other charges that he picked up while destroying his house) showed up in a sleeveless shirt that he got from a tough man competition. Needless to say, the judge was not impressed.

In Buffalo they had what was refered to as "sunrise court" on Sunday mornings to handle all the arrests over the weekend. It was quite entertaining to go there as a spectator... One time there was a bride and groom that had been arrested for drunk and disorderly at their wedding!
Spent their honeymoon in the drunk tank. :roll:

More court hilarity....

Not too long ago I got a 68 in a 50 in a construction zone. Long story short: I'm a moron and should have paid closer attention to the speed limit signs.

Anyway, since it's more that 15 over, I have to go to real court, not just traffic court. First 3 cases: No Operators License (driving without a license). All three guys "You ever done this before?" "No your honor." "Yeah, well, just let us look it up, and if you're telling the truth, we'll let you go." Each of the 3 guys had 4(!!!!) or more OUTSTANDING WARRENTS for not showing up for 4 or more previous no operators license tickets. Sorta made me feel my chances for success were pretty good. :)

Just before I was called, they tried a kid (18 years old) for Operating a Pharmacy without a License. What, you may ask, the hell is that? Well, it seems junior had stolen his brothers ritilan (sp??) or some similar drug, and was selling it at school. Nice. Kids are so creative these days. :) And they say free enterprise is dead. Kid ended up getting 72 hours community service, 2 yrs probation, and a $500 fine.

These were two highlights in a long line of other rather humourous goings on. An honourable mention goes to the guy who drove off without paying for gas, and upon realizing it and returning to the gas station to pay was arrested. Your Tax Dollars at Work!
