If they went out a day or two after the incident and pulled that, then I think they are admitting guilt. I'm pretty sure my E46 would hit something over those and it is not lowered so they can't play the low car bullshit.
First and foremost, I hate getting these calls because I feel bad for most people. I will say that my company fixes 75-80% of cases like this. The other 20 to 25% are folks trying to pull a fast one.
Those water valves HAVE to be that high to meet the final surface but I'm going to guess they adjusted it and planned on not leaving it for long then the rain screwed things up. They should have put the asphalt around it regardless and/or closed the lane off.
The City generally isn't going to do anything, if its a DOT road, they aren't doing anything either, this is all on the contractor performing the work, they technically "own" the road while its under construction. I'm sure this isn't their first time dealing with this but do not settle for less than you are comfortable with. Do you know who the contractor is? If its a DOT job and need help finding out who to talk to, I can generally point folks in the right direction.
